HOLD HARMLESS AGREEMENT
FOR COURSE PARTICIPANTS
RECITALS
- This Hold Harmless Agreement is by and between Dark Angel Medical, LLC and the undersigned class participant/student prior to the participant/student engaging in Dark Angel Medical, LLC’s “Direct Action Response Training”.
- Dark Angel Medical, LLC is offering and providing this course for the benefit of the individual participant/student wishes to learn and train in the use of emergency lifesaving skills. This does not confer the ability or permission to the student to instruct others.
- Dark Angel Medical, LLC will use its best efforts to create a reasonably safe and effective environment for training. It is, however, not possible to create an absolutely safe, risk-free environment. Through this waiver, the participant/student acknowledges this fact and assumes any and all risks and liabilities related to firearms and live ammunition and medical skills training.
TERMS
- Participant/student hereby absolves Dark Angel Medical, LLC of any damages that the participant/student may experience in participating in the course. Participant/student agrees to hold Dark Angel Medical, LLC, its employees and its agents harmless from any sort of injury or damage experienced by the participant/student in taking the course. Participant/student expressly waives any and all rights and causes of action Participant/student may have for compensation at law and equity, including negligence, from Dark Angel Medical, LLC, its employees or its agents in such event that the participant/student is injured and shall indemnify the same.
- This agreement shall be binding upon participant/student, his/hers heirs, assigns, administrators, executors and estate. It shall also be interpreted under Colorado Law
WAIVER AND ACCEPTANCE OF LIABILITY
FOR COURSE PARTICIPANTS
RECITALS
- This Waiver and Acceptance of Liability (“Waiver”) is by and between Dark Angel Medical, LLC and the undersigned class participant/student prior to the participant/student engaging in Dark Angel Medical, LLC’s “Tactical Aid Course”.
- Dark Angel Medical, LLC is offering and providing this course for the benefit of the participant/student and others who want to learn and train in the use of emergency lifesaving skills.
- Dark Angel Medical, LLC will use its best efforts to create a reasonably safe and effective environment for training. It is, however, not possible to create an absolutely safe, risk-free environment. Through this waiver, the participant/student acknowledges this fact and assumes any and all risks and liabilities related to this training.
TERMS
- Dark Angel Medical, LLC will allow the student/participant entry into the course after the student/participant signs this waiver.
- All instructions and directions given to the student/participant during the course by Dark Angel Medical, LLC’s agent, the instructor, will be followed.
- Due to the fact that we, Dark Angel Medical, LLC, cannot provide a 100% risk-free environment, the participant/student hereby assumes the risk of any and all injury that may result from participation in the course.
- This waiver shall be binding upon participant/student, his/hers heirs, assigns, administrators, executors and estate. It shall also be interpreted under Colorado Law.
- The Participant/student acknowledges the fact that all written material and/or products with the Dark Angel Medical, LLC copyright or trademark is property, both real and intellectual, of Dark Angel Medical, LLC and that no attempt will be made to reproduce or distribute said material and/or products by the Participant/ student or any assigned agent without the expressed written consent of Dark Angel Medical, LLC.
- Noncompetition: After the signing of this waiver, Participant/Student shall not engage in competition with Dark Angel Medical, LLC for a period of 10 years within the United States of America unless you are currently engaged in instructional duties before taking this course.
- Competition Defined: Competition means engaging in self-employment in emergency medical training or providing services similar to those provided by Dark Angel Medical, LLC.
- Participant/student acknowledges that they do not have any physical disability, limitation, illness or other condition that would affect your ability to participate safely in any aspect of this program.
- Participant/student acknowledges they are not under the influence of any prescription/non-prescription drug(s) or alcohol that would influence your safe participation in any aspect of this program.
- Participant/student acknowledges they will not share passcodes or distribute this course to anyone besides the individual who signs up for the course.
- This waiver shall be binding upon participants/student, his/hers heirs, administrators, executus and estate. It shall also be interpreted under Colorado Law.
12. Participant/Student acknowledges and accepts that they will see graphic (bloody) material in both still images and video in the course of the class, not to shock, but to further the learning process. Participant/student further acknowledges that they may step out of class during these graphic portions of class without reprisal. In addition, the Participant/student acknowledges that if they choose to self-eliminate (ie. Leave the class of their own accord) because the Participant/student feels uncomfortable or ill, the Participant/Student acknowledges and accepts that they will receive no monetary refund or credit for the class in which they were enrolled.
